HB 119 –
Prohibition of Sales of Alcoholic
Liquors to Certain Persons
This bill removes the prohibition on selling an alcoholic beverage
to a person with a mental condition or mental disability. The
prohibition is a vestige from the 1935 Code, predates enactment
of the federal ADA and Delaware Equal Accommodations Law,
and is overly broad.

HB 5 –
Addition of E-Cigarettes to
Clean Indoor Air Act
This Act adds electronic smoking devices to the Clean Indoor
Air Act and prohibits the use of electronic smoking devices in all
public places where smoking is prohibited under current law.
Amendments have been added to the bill to exclude shops
where e-cigarettes are sold (vape shops). Another vote is
expected soon.

SB 89 –
Delaware Food
Code related to Certified Food
Protection Manger Program
In May 2014, the Department of Health and Social Services
(Department) promulgated the State of Delaware Food Code,
§ 4458, Title 16 of the Delaware Administrative Code. The
State of Delaware Food Code requires all food establishments,
required to be permitted by the Department, to have a
certified food protection manager. This Act would require the
Department to exempt charitable and fraternal organizations
from this requirement. At least 7 other states have created a
similar exemption; those states are: Florida, Indiana, Minnesota,
Pennsylvania, Rhode Island, Texas, and Utah.
