aleigh, NC – Many local government SystemMembers of NCRWA
as well our Associate Members (suppliers and contractors) that do
business with local governments know the burden of the E-Verify
requirements in North Carolina since 2013 (Session Law 2013-
418). Thankfully after ongoing discussions with lawmakers in
Raleigh by various organizations including NCRWA, relief from
much of this administrative burden came in the form of Session
Law 2014-119 (House Bill 369).
Section 13 of this new law clarifies that E-Verify is only required
for local government (city and county) contracts that are subject
to the formal billing laws as described in NCGS 143-129.
Summarizing the formal bidding requirements of NCGS 143-
129, local governments are required to use the bidding processes
(and thus E-Verify) if the contract is for construction or repair
work requiring the estimated expenditure of public money in the
amount of $500,000 or more or if the contract is for purchases
of apparatus, supplies, materials, or equipment requiring an
estimated expenditure of public money in the amount of $90,000
or more. Obviously, these clarifications greatly reduce the burdens
as E-Verify is no longer required for smaller and more routine
projects and purchases. Session Law 2014-119 went into effect on
October 1, 2014.
