Is Pay for Performance Dead?
Workplace Application:
Motivate employees with a thoughtfully designed,

How much control do employers really have to motivate employees to produce
desired results for the organization? One strategy is to design and implement
a motivational and cost-effective compensation plan. Learn to thoughtfully
design incentive pay plans based on research, cost analysis and quantitative
assessments of effectiveness of prior or existing plans. Know when to

Health Exchanges:
What We Know, Where We’re Going
Workplace Application:
Maximize your use of private exchanges by
understanding how they benefit both individuals and employers.
Research shows that employers are considering private exchanges to provide
benefits to their employees or retirees, and by 2018, 40 million Americans
will be enrolled in private exchanges. Despite the predictions of a radical
transformation of the health insurance landscape, research by Accenture
shows that 83 percent of U.S. consumers are entirely unfamiliar with private
exchanges. Understand the complex exchange marketplace to determine which
exchange is best for your company’s demographics. Leverage exchanges to
build a cost-effective health care strategy.

Can Anyone Be Fired Anymore?
Workplace Application:
Accurately assess the risks associated with a
proposed termination and minimize the risk of litigation and liability.
HR professionals are increasingly reluctant to terminate an employee, even
where there are legitimate performance or behavior-related problems. But how
likely is it that a lawsuit will actually be threatened or filed? Examine the current
state of wrongful termination litigation in California and the U.S. to understand
the areas of particular vulnerability where wrongful termination may be alleged,
including aggressive recruiting and claims of breach of contract; violations of a
company’s code of conduct or work rules and handbooks; performance-related
terminations of whistleblowers and victims of discrimination and harassment;
layoffs; and termination for performance or behavioral problems.

Stop the Abuse:
Managing Employee Medical Leaves
Workplace Application:
Avoid legal risk through expert advice on navigating the
requirements and challenges of complicated medical leave of absence laws.
Navigating the various medical leave of absence laws is one of the most challenging
areas for the HR practitioner. More than 3,000 cases based on violations of
family care or medical leave laws are filed with the California Department of Fair
Employment and Housing each year, recently resulting in class action lawsuits
netting multi-million dollar settlements with employers. Avoid the legal landmines.
Understand when disciplinary action can be taken for abuse of leave and when
to request additional information. Obtain medical information without violating the
Genetic Information Non-Discrimination Act and other medical privacy laws.
