required to follow the procedures in Chapter
150B of the General Statutes regarding rule
making. This includes providing public
notice of proposed rules, public hearings on
the proposed rules, and action by the CPH
to adopt final rules. Once final rules are
adopted, they are required to be submitted
to the Rules Review Commission (“RRC”).
The RRC reviews adopted rules to ensure
that the rules are within the authority
delegated to the agency by the General
Assembly, are clear and unambiguous, and
that the rules are adopted in accordance
with procedures in Chapter 150B. If the
RRC receives timely objections from 10
or more persons to rules submitted to it
for review, those rules do not become
effective until there is an opportunity for
a bill disapproving the rules to be filed in
the General Assembly in which case the
rules become effective or die depending
on whether such a bill becomes law or not.
If less than 10 objections are received, the
rules generally become effective on the
date specified in the rules once the RRC
approves the rules.”

of the SWPP, for review and update of
the SWPP by suppliers of water, and for
reporting requirements. The CPH is required
by this new law to provide an interim report
to the Environmental Review Commission
(“ERC”) not later than April 1, 2015,
regarding its progress in implementing the
requirements of this new law, and to prepare
a final report to the ERC within six months
of adopting final rules implementing this
new law. There is no deadline in this new
law for proposing or adopting final rules.
